4. Post-consumer asphalt shingle fines may be used as raw material for the production of asphalt in a hot mix asphalt plant when
(1) the plant was modified to use the material; and
(2) the material is introduced in the recycled materials entry zone or the mixing zone.

4. Authorization: No person may build or alter a hot mix asphalt plant, or undertake the operation or increase the production of such a plant, without an authorization issued by the Minister in accordance with section 22 of the Act.
For the purposes of this section, there is an increase in the production of a hot mix asphalt plant only when the nominal capacity of the plant is increased.
